1. Acceptance of Terms

By accessing or using the service (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and the operator of the Service.

Continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. We reserve the right to update these Terms at any time, and we will notify you of material changes where required by applicable law.

2. Description of the Service

The Service operates exclusively as a delivery and messenger service for Mega Millions Florida Lottery and Powerball Florida Lottery tickets. The Service does not sell lottery tickets outright, act as a lottery retailer, or engage in the sale of gambling products.

You pay solely for the delivery service, which includes the procurement, handling, secure storage (where applicable), scanning or imaging, and international delivery of lottery tickets that you request. The tickets themselves are purchased from authorized Florida Lottery retailers using your explicit instructions and the funds you allocate for the official face value of the tickets. Our role is limited to acting as your authorized agent and courier for facilitation and delivery purposes only.

All payments made through the Service are consideration for the delivery, procurement, and related facilitation services rendered. You retain beneficial ownership of any tickets obtained through the Service. The Service does not guarantee the purchase of any specific ticket, the outcome of any lottery draw, or the validity of any ticket beyond what is provided by official Florida Lottery channels.

3. Eligibility and User Representations

To use the Service, you must:

Be at least eighteen (18) years of age (or the legal age of majority in your jurisdiction, if higher).
Be physically located in a jurisdiction where participation in the Florida Lottery and use of this delivery service is legally permitted.
Have the legal capacity to enter into binding contracts.

You represent and warrant that:

Your use of the Service complies with all applicable laws in your jurisdiction of residence and the jurisdiction from which you access the Service, including but not limited to the laws of the State of Florida and the State of Israel.
You are not a resident of any jurisdiction that prohibits or restricts participation in foreign lotteries or the use of courier/messenger services for lottery tickets.
You are not using the Service for any illegal, fraudulent, or unauthorized purpose.
You will provide accurate and complete information when requesting tickets.

The Service is not intended for use by individuals under the age of 18 or in any jurisdiction where it would violate local gambling, lottery, or consumer protection laws. You are solely responsible for ensuring your eligibility and compliance.

4. Ordering Process and Payment

When you place an order through the Service, you select your desired lottery numbers and provide payment. Your payment covers:

The official face value of the requested lottery tickets (reimbursed to authorized retailers for procurement); and
The service and delivery fee for our courier, handling, and facilitation services.

All payments are final and non-refundable, consistent with Florida Lottery rules that ticket sales are final. You authorize us to use the funds provided to procure the tickets on your behalf from authorized Florida retailers and to deliver them to you. We reserve the right to reject any order for any reason, including suspected violation of these Terms or applicable law.

We use secure third-party payment processors. You are responsible for any fees charged by your financial institution or payment provider.

5. Ticket Procurement, Ownership, and Delivery

Upon receipt of a valid order and payment, we will use commercially reasonable efforts to procure the requested tickets from authorized Florida Lottery retailers and deliver them to you via the method selected (digital scan/image or other secure delivery format suitable for international users).

You are the sole owner of any procured tickets. We act solely as your limited agent and courier. Tickets procured through the Service remain subject to all official Florida Lottery rules, terms, and regulations.

Delivery times are estimates only. International delivery may be subject to customs, postal, or other logistical delays, for which we bear no responsibility. We are not liable for loss, damage, or delay in delivery once the ticket has been dispatched through our chosen carrier or digital method.

6. Prizes and Winnings

You are solely responsible for claiming any prizes or winnings in accordance with Florida Lottery rules and procedures. We do not claim, hold, or manage prizes on your behalf except as explicitly agreed in writing for specific low-value prizes where permitted by law.

We will provide reasonable assistance in notifying you of potential winning tickets based on publicly available draw results, but we make no guarantees regarding prize notification, validation, or payment. All prize claims must be made directly with the Florida Lottery or its authorized agents. Large prizes may require in-person validation in Florida.

You acknowledge that the Florida Lottery determines all prize eligibility, validity, and payment. We have no control over, and assume no liability for, the Florida Lottery’s decisions or actions.

7. Disclaimers and No Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

We do not guarantee:

That any ticket will be successfully procured or delivered.
That any ticket will win a prize.
The accuracy of draw results or prize information (which are provided by the Florida Lottery).
Continuous, uninterrupted, or error-free operation of the Service.

The Service is not affiliated with, endorsed by, or operated by the Florida Lottery or any government entity. We are an independent delivery service only.

8. Limitation of Liability

To the fullest extent permitted by law in Florida and Israel, our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount of service and delivery fees you paid to us in the twelve (12) months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

9. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Service.
Your violation of these Terms or any applicable law.
Your breach of any representation or warranty.
Any claim that your participation in the Florida Lottery violates laws in your jurisdiction (including Israeli gambling laws).

This indemnification obligation survives termination of these Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, and, to the extent applicable to users or operations in Israel, the laws of the State of Israel, without regard to conflict of laws principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in Florida, USA, or, where mandatory under Israeli law, in the competent courts of Israel. You agree to submit to the personal jurisdiction of such courts.

For users in Israel, you additionally acknowledge that the Service is provided strictly as a foreign lottery messenger/delivery service in compliance with applicable Israeli regulations concerning messenger services for permitted lotteries.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms or applicable law. Upon termination, your right to use the Service ceases immediately, but any procured tickets remain your property subject to delivery where possible.

12. Miscellaneous

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver. Our failure to enforce any right or provision does not constitute a waiver.

Entire Agreement. These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.

Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, war, terrorism, government regulations, or Florida Lottery actions.

By using the Service, you confirm that you have read and agree to these Terms in their entirety. These Terms are designed to comply with applicable laws in Florida and Israel and to protect the legal interests of the Service provider operating under those jurisdictions.
